End User License Agreement (EULA)

Welcome to the Pella Pro Sports Market App!

This End User License Agreement ("EULA") governs your use of the Pella Pro Sports Market ("Pella") mobile application ("App") available on Apple platforms, including iOS and iPadOS.

1. Acceptance of Terms

By downloading, installing, or using the App, you agree to be bound by this EULA. Pella may change the EULA at any time by posting a revised version on its website. Any change shall come into effect and be deemed accepted if you continue using the App after the revised version is posted. Please review this EULA carefully before you use the App, and continue to check here periodically for any updates.

2. User Accounts

Some features of the App may require you to create a user account. When doing so: You will be asked to provide your first name, last name, club or company name and role (where relevant), email address, and mobile telephone number. You agree to provide accurate and complete information during the registration process and to update such information to keep it accurate and current.

3. Licence

Pella grants you a non-exclusive, non-transferable, royalty-free revocable licence to use the App in accordance with this EULA. Usage of the App is free of charge, although we reserve the right to impose charges at our sole discretion, and on reasonable notice to account holders. All trademark rights, copyright, database rights and any other intellectual property rights of any nature vesting in the App together with the underlying software code are exclusively owned by Pella and/or its group of companies.

4. Conditions of Use

You will comply with the following conditions of use at all times: You will comply with all applicable laws and regulations and will not use the website for any improper or fraudulent purposes; You acknowledge that your use of the App may be subject to third-party terms, such as (but not limited to) Apple's App Store Terms of Service; You will not (nor allow third parties on your behalf to): make and distribute copies of the App attempt to copy, rent, sub-licence, loan, merge, reproduce, alter, modify, reverse engineer, disassemble, decompile, transfer, exchange, translate, hack, distribute, harm or misuse the App; or create derivative works of the App of any kind whatsoever. Pay any third party charges in order to use the App, including but not limited to any data charges levied by any mobile network providers. The App shall not be used by or shared with anyone under the age of 13 years old.

5. System Requirements and Availability

In order to use the App, you will require a compatible mobile telephone or handheld device, internet access, and an operating system of iOS 14 or higher. We may release updates, patches, or new versions of the App from time to time. You agree to promptly install such updates to ensure the security and functionality of the App. You acknowledge and agree that: the App is provided over the internet and mobile networks and thus the quality and availability of the App may be affected by factors outside Pella’s reasonable control. Pella, its group of companies and sub-contractors do not accept any responsibility whatsoever for unavailability of the App, or any difficulty or inability to download or access content or any other communication system failure which may result in the App being unavailable. Pella will not be responsible for any support or maintenance for the App. To the maximum extent permitted by law, Pella excludes all implied warranties in relation to the App. The App and software are provided “as is” and “as available” without warranty of any kind.

6. Privacy Policy

7. Termination

We reserve the right to terminate or suspend your access to the App at any time, for any reason, including but not limited to any breach of this EULA.

8. Disclaimers

Content Accuracy We aim to provide accurate and up-to-date information, but we cannot guarantee the completeness, accuracy, or reliability of the content on the App. No information displayed or shared within the App should be considered as financial or legal advice. Third-Party Links We may include links to third-party websites or services. We have no control over these third-party sites and are not responsible for their content or actions. Your use of these sites and services is at your own risk.

9. Limitation of Liability

To the maximum extent permitted by law, Pella shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues arising out of your use of the App.

10. Governing Law

This EULA is governed by and construed in accordance with the laws of England and Wales, and the English courts shall have exclusive jurisdiction over any dispute.
